DMCA Policy

Homemade Potato Chips respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly provided to us.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Homemade Potato Chips website or services, please notify our designated Copyright Agent as set forth below.

Filing a DMCA Notice (Copyright Infringement Notification)

To file a DMCA notice, you must provide a written communication that includes substantially the following:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL where the copyrighted work exists or a copy of the copyrighted work.
  3.   6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Counter-Notification

If you believe that the material you posted was removed or disabled by mistake or misidentification, you may send a counter-notification to our Designated Copyright Agent, provided it includes substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., specific URLs).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Homemade Potato Chips may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
